Terms and Conditions.

1. Agreement and eligibility

By accessing or using Forma, you agree to these Terms and our Privacy Policy. If you use Forma for a company or another organization, you represent that you have authority to bind it. You must be at least 13 and legally able to enter into these Terms. If you are under the age of majority where you live, a parent or guardian must approve your use.

2. Accounts

Provide accurate account information, keep your credentials secure, and promptly tell us about unauthorized use. You are responsible for activity performed through your account. We may refuse, suspend, or close accounts used in violation of these Terms or to protect Forma and its users.

3. Plans, AI credits, and free publishing

Paid plans provide one shared AI credit balance for websites, web apps, images, logos, social posts, and edits. At the date above, a new creation uses 10 credits and an AI refinement uses 5 credits. Credits reset with each billing cycle, do not roll over, cannot be transferred, and have no cash value. A failed generation is returned only when Forma can reliably verify the failure.

You may preview samples and prepare a prompt without using credits. Publishing, unpublishing, and downloading work you already created are free and do not consume AI credits. Current prices, plan allowances, and included features are shown before checkout and may change for future billing periods with notice where required.

4. Billing, renewal, and cancellation

Subscriptions are billed in advance through Stripe and renew automatically at the interval shown at checkout until canceled. Taxes may apply. You authorize the applicable recurring charge and must keep your payment information current. You can cancel through Forma's account menu and Stripe billing portal; cancellation takes effect at the end of the current paid period.

Except where the law requires otherwise or Forma expressly states a different policy, payments are non-refundable and unused credits expire at the end of the applicable cycle. Nothing in these Terms limits any mandatory consumer cancellation or refund right.

5. Your content and permission to operate Forma

You keep your rights in prompts, files, brands, and other material you provide. You represent that you have all rights and permissions needed to use that material. You grant Forma a limited, worldwide, non-exclusive license to host, copy, process, modify, transmit, display, and publish your content only as reasonably needed to operate, secure, improve, and provide the service you request.

Subject to these Terms and to the extent permitted by law, Forma does not claim ownership of the generated result delivered to you. AI-generated material may not qualify for intellectual-property protection, and the same or similar result may be generated for another user.

6. Publishing and responsibility for your project

Publishing makes your selected website or web app publicly available. You are the publisher and are responsible for its claims, products, services, accessibility, legal notices, privacy practices, and compliance with laws that apply to you. Forma may remove or disable content that violates these Terms, infringes rights, creates risk, or must be removed by law.

7. Acceptable use

You may not use Forma to:

• break the law or violate another person's rights;
• upload material you do not have permission to use;
• create malware, phishing, fraud, spam, or deceptive content;
• exploit or endanger children or create non-consensual content;
• harass, threaten, impersonate, or unlawfully discriminate;
• probe, disrupt, bypass, reverse engineer, or abuse Forma's systems, limits, authentication, or credit controls;
• resell access or use automated means that burden the service.

8. AI output and third-party services

AI output is probabilistic and may be incorrect, incomplete, offensive, or similar to existing material. Forma does not provide legal, medical, financial, or other professional advice. Review all facts, permissions, code, accessibility, and safety before relying on or publishing a result.

Forma relies on third-party services including AI providers, Supabase, Google, Stripe, and hosting providers. Their availability and separate terms may affect features. We are not responsible for third-party products or services outside our control.

9. Service changes and termination

We may change, pause, or discontinue parts of Forma, impose reasonable limits, or update credit costs to reflect service costs and product changes. When reasonably possible, we will give notice of material changes that negatively affect an active paid plan. You may stop using Forma at any time. Provisions that by their nature should survive termination will remain in effect.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMA IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND WARRANTIES THAT THE SERVICE OR OUTPUT WILL BE ACCURATE, UNIQUE, SECURE, OR UNINTERRUPTED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMA AND ITS OWNERS, AFFILIATES, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY ARISING FROM FORMA WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID FOR FORMA DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. NOTHING HERE EXCLUDES LIABILITY THAT CANNOT LEGALLY BE LIMITED.

12. Indemnity and disputes

To the extent permitted by law, you will defend and indemnify Forma from third-party claims, losses, and reasonable costs arising from your content, your published project, your violation of these Terms, or your infringement of another person's rights. Before filing a formal claim, you and Forma agree to try in good faith for 30 days to resolve the issue informally. Any unresolved claim must be brought individually in a court with lawful jurisdiction; class or representative claims are waived where that waiver is permitted.

13. General terms

These Terms and the Privacy Policy are the agreement between you and Forma about the service. If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a term is not a waiver. You may not assign these Terms without our consent; Forma may assign them as part of a reorganization or transfer of the service. We may update these Terms and will post the updated date and provide additional notice when required. Continued use after an update takes effect means you accept the revised Terms.
